You can certainly file a waiver on these facts and it is better to have children but that is not required. Waivers are approved without children...

It is almost impossible for your fiance and children to get visitor's visas. You need to discuss this with an immigration attorney.
Does applying for i-765 (EAD card) while on H1B visa cancel the H1B visa if the EAD card is granted?

Applying for the green card based on marriage and getting an EAD does not impact your H-1. What would impact the H-1 is if you use the EAD to work...

It really depends on the exact wording in the I-129 and/or supporting documents for your H-1, but more than likely you will need a new H-1 to teach...
