If you have been out of the US for more than twelve consecutive months, you must go through the lottery again.

Just apply for an R-2 visa while you are home. I assume your husband is going with you so you can just apply for the visas together.

None of this is necessary. Employment-based cases can file for AOS even if there has been a period without status, unauthorized employment, etc....
