Interesting. The "dry foot rule"; haven't heard that in a long time. If he is here a year he can adjust status and you will be eligible for LPR...

Most schools in Texas will allow you to attend without any status at all. So, yes, U status is fine.

Typically the Immigration Service will not take any action against you if the I-130 and I-485 are pending, and assuming they are also approved later.

Probably an E-2 investor visa would be best but you really need to meet with a qualified immigration attorney for something this complicated.

Any US citizen or permanent resident can be a co-sponsor or he may be able to use his own income.
