You are not in H-4 status when you are out of the US. US immigration law stops at the border.

Unless the employer is a university or related entity or you were in H status before, you will have wait to file until next April 1, 2015.

You need a lot of things but if he entered in F-2 status the last time, he does not need a 601 waiver since is he out of status.

I am not sure how you expect to qualify for DACA but if you are eligible you can get an EAD regardless of your prior OPT.

This question has already been answered and yes you can cross charge with your wife. It is nativity which counts, not citizenship.
