Incompetent. Plea Lawyer.

David's trial was my only loss of 2016. Before and after his case F13-55770, I won murder cases, aggravated assaults, theft, indecent exposure, DWI, etc. Please make your own decision regarding David's credibility. We urged a pretrial motion alleging a violation of 6th Amendment Right to Confront Witness, which had NEVER BEEN filed before in Dallas County according to the judges I conferenced with. After his judge wrongly (I believe) allowed the State to continue the trial violating our 6th Amendment Rights, I expertly made a record for appeal purposes. The case was not made "by a dead man" but instead through the eyewitness testimony of his son and grandson. David wasn't charged with "running over" someone, he was being charged with injuring an elderly man, who (after the botched repo incident) could NO LONGER WALK, until the date of his untimely death. I worked tirelessly for over two years and twenty-two court appearances trying and get F13-55770 dismissed. Ultimately, David's felony record, the judge's 6th Amendment mistake, and the family's compelling testimony resulted in a finding of guilt. HOWEVER, given all of THAT, the judge STILL wanted to keep the case off of David's record due to my representation, but couldn't because of his previous felonies and his plea of 'not guilty' before trial - so she ultimately gave him the shortest probation possible (2yrs) and a $0.00 fine - even though she thought he was responsible for permanently crippling the victim during the repossession! Perhaps the most telling thing, is that even though I preserved appeal (and I believe that the Court of Appeals would have vacated the judgment based upon 6th Amendment principles) AND I secured a free appeal lawyer for David, he NEVER FOLLOWED THROUGH with his right to appeal! Instead he got on the Internet and whined like a child. NOW (5/6/2017) David has a warrant for his arrest and a pending probation violation because he cannot follow a few simple rules to stay out of prison. Yes, I am disappointed with case F13-55770 but mostly because I could not get my client to listen to good sense during negotiations for dismissal, I did not draw a Constitutionally-minded judge when the case was filed, and that David refused to appeal the matter. Instead he stuck his head in the sand and screwed-up his probation. But again, this was my ONLY loss in 2016. Thank you AVVO for your services, and thank you David.
