Collaborative law is a fantastic innovation in family law. In a collaborative case the parties and lawyers sign an agreement to negotiate their way through the issues in the case and to stay out of the court. To insure everyone stays in the negotiation process, if the parties cannot make a settlement agreement the lawyers are obligated to withdraw from representation of the clients and refer them to other lawyers to litigate the unsettled issues. The withdrawal obligation gives the lawyers and clients a huge incentive to stay at the bargaining table.
Some cases simply cannot be settled - usually because of one party's anger or unrealistic expectations.
