Chad Henson assists clients in all legal matters related to patents and other areas of intellectual property litigation and other business litigation. He has built substantial experience in patent damages and the intersection of patent law with administrative and antitrust law. He works with industry clients, financial institutions, and law firms to analyze and solve complex problems at the intersection of law and economics and has litigated cases involving a broad range of technologies, including lighting, optics, wireless networking, machine-to-machine communication, and consumer electronics.
Before entering private practice, Chad held academic and research positions at nationally recognized institutions around the United States, including the University of Illinois, Washington University in St. Louis, the Mercatus Center at George Mason University, the Property and Environment Research Center, and the Institute for Humane Studies. He has also served as a consultant to professional and academic research institutions, law firms, and financial services firms, and his scholarly work has been published in leading journals in the fields of law, economics, and finance. He has also given presentations on patent damages, use of data analytics to predict judicial decision-making, and economic analysis of law at various conferences and seminars.
Chad previously spent time as senior litigation counsel for a company focused on providing in-house legal solutions to individual inventors and small companies to monetize their intellectual property.
Highlights of Chad’s experience include:
Obtained en banc ruling that the 35 U.S.C. § 314(b) prohibition on appeals of decisions to institute inter partes review does not preclude review of the timeliness of an IPR petition under § 315(b), reversing multiple panel decisions.
Represented plaintiffs in patent infringement action as member of four-attorney team that secured a $25 million settlement just prior to trial and obtained over $100,000 in fees on a motion to compel.
Represented plaintiff in suits arising out of undisclosed liabilities in merger transaction. Obtained multimillion dollar-settlements from former stockholders, then brought suit against officers in negligent misrepresentation action and defense of counterclaims for fraud, obtaining successful settlement.
Represented plaintiff in patent infringement action as member of three-attorney team, obtaining favorable settlement following grant of summary judgment of infringement and Daubert ruling striking defendants’ damages expert.
