you can have dual status as H1 and when your priority date is current you are in "adjustment of status pending" status
Is the category C9 or C9P for I-765 for EAD marriage based AOS?

We need more information but C9 is the correct category for spouse adjustment of status.

It should not create a problem as long as in the drivers license application you did not say you were a citizen or misrepresent your status.

If he has had a clean record for 5 years and these were simple DUI's there should be no problem.

It is possible if you enroll in a US. school pay the required fees and get issued an I-20 form.

if case was dismissed with no deferred adjudication, probation or anything you still have a clean record. If not, you need to have a clean record...
