Mr. Adame spent the majority of the next forty-five days in the hospital. Upon being discharged, Mr. Adame again sought workmen compensation benefits. Mr. Adame’s claim was denied under the guise that he had failed to provide notice of his claim within the mandated thirty day notice period. Mr. Adame argued at the contested case hearing that he provided actual notice to his employers on at least three separate occasions.
