OUTCOME: Prevailed by filing motion and convincing prosecutor to dismiss the case.

67-5 District Court case in Flint. Police arrested client and charged him with 3 felonies: Carrying a Concealed Weapon, Felon in Possession of Weapon & Ammunition and threatened to add a 4th for Felon ... y Firearm (a mandatory 2 years in prison), if we went to a preliminary examination. Immediately, filed a motion to dismiss and the prosecutor agreed to dismiss the case before conducting the exam or hearing on the motion. Client had a BB gun, which is not a firearm under current Michigan statute. Client should have never been charged in the first place!

OUTCOME: Prevailed on Motion to Suppress Evidence and the case was dismissed

Client was arrested on warrants. He was then questioned regarding the presence of contraband including guns and drugs. The police said that he volunteered information about a gun being present and co ... nsented to a search by nodding his head. The court found that the client's statements were inadmissible because he was not read his Miranda rights and that the gun and drugs were suppressed because the police conducted a non-consensual search of a hotel room. Consequently, all of the criminal charges were dismissed.

I personally conducted direct and cross examination of several witnesses, including experts.
