The descriptions below only address trial cases, but we regularly represent military clients facing administrative board hearings, discipline and investigations - such as discharge/separation, FEB, MEB/PEB, DRB, BCMR, etc. While the case descriptions that follow describe cases that were successfully defended, it is important to understand that no lawyer can guarantee an outcome in any particular case, and past successes cannot predict future outcomes. U.S. v. XXXXXXX - Rape, (Sexual) Assault, Conduct Unbecoming an Officer and Gentleman

OUTCOME: Acquitted of rape and claims of non-consensual touching.

Senior (retirement eligible) officer accused of rape and sexually related assault by two women/complainants. After the Article 32 hearing and all charges referred to trial by court-martial, one compla ... inant recanted her allegations and admitted the interactions with the client were consensual. The second complainant stuck to her claim that she was a victim. Fully litigated trial before officer court members. Client was completely acquitted of rape and claims of non-consensual touching (sexual assault). Convicted only of consensual sex as Conduct Unbecoming an Officer and Gentleman. Sentenced to no punishment. Given the sentencing options available to the court members, down to even a reprimand, the sentence of no punishment was a strong message about what they thought of the case and the allegations.

Military officer client accused of 20+ allegations of larceny, fraud and wire fraud connected with claimed fraudulent investments. During course of investigation leading to trial, the defense aggressi ... vely uncovered that the real perpetrator was a corporate officer of one of the investment companies, who had a history of business fraud. Court-martial was dropped on eve on trial in favor of administrative action. If client was convicted at trial, he faced decades in prison and dismissal (dishonorable discharge).

OUTCOME: Case dropped.

Military officer accused of years of Joint Federal Travel Regulation (JFTR) fraud when on active duty orders during combat operations in the Middle East. During the investigation of the case leading up ... to the pretrial Article 32 hearing, the defense aggressively attacked the government's understanding of the JFTR and exposed that their theory of the case was legally incorrect. The case was dropped. If this case proceeded to trial and the client was convicted, he faced decades in prison and dismissal (dishonorable discharge).
