In March of 2016 I was notified of my medical retirement. Within days of that I was informed that I had shown positive on a command urinalysis for Oxycodone. The investigator informed me that I had an expired prescription. I was then informed of the next steps, which were XOI, Captains Mast, and ASB.... After a CID investigation I was served with a GOMOR accusing me of fraud, larceny and fraternization. The accusation was that I had corrupted a lower ranking Soldier by conspiring for him to receive a higher BAH amount during deployment by using my address. The entire accusation was false. The E4... was going to rent my house from my family, signed a lease but his family never moved in. The CID investigation and ESC wanted to blame me for the E4 submitting the lease and attempting to get a higher BAH than the area where his family lived. Mr. Carpenter advised me prior to the CID interview so I knew exactly what to expect. He also drafted an extensive 7 page response to the GOMOR. His rebuttal showed 4-5 different regulations supporting that I had the authority to rent a property to the E4 if I chose to. Once the ESC received his response they rescinded the GOMOR and the case was closed. I am confident that the advisement I received prior to the CID interview coupled with Mr. Carpenter's fine knowledge of regulation and ability to articulate that understanding into responses are the reasons the case was dismissed entirely.
