Administration Separation Board, Positive Urinalysis, Petty Officer First Class

In March of 2016 I was notified of my medical retirement. Within days of that I was informed that I had shown positive on a command urinalysis for Oxycodone. The investigator informed me that I had an expired prescription. I was then informed of the next steps, which were XOI, Captains Mast, and ASB.... I immediately did my reach on the best military attorneys. Every website and phone call I made indicated that Stephen Carpenter is the best there is. Stephen is a professional in every sense of the word. He knows his way around the courtroom and know's how to exemplify the facts. He was able to find facts the command didn't think to look into and also emphasize my medical conditons. Through his hard work and diligence, my board was a no cause found for separation, unanimously. My family and I cant thank him enough for what he has done. My name has been vindicated and I can walk around with the pride I worked so hard to achieve. Also his intern Jason Greene is phenomenal. Mr. Carpenter successfully defended me at my Board of Inquiry (BOI) and I was retained for future service. I can't explain in words what that meant for my Family and I. I was up against the wall for what was considered a semi fraternization case of adultery. I decided to call Mr. Carpenter w...hen my assigned Military Attorney's told me I basically had no shot at retention after 19 years of service. After 19 years of service I was about to be told to go home with nothing. When I called him he gave me hope from the very first phone call. He didn't guarantee me a successful outcome but to finally talk to a competent attorney was relief enough. The hard work and dedication he gave me from day one was second to none and to see him in action at my BOI was eye watering! Stephen is a brilliant communicator not just in court but also with my family from the start. If I could recommend him to every single person seeking an attorney I would do just that. He is worth every penny and looking back I would've paid double his asking price… He's that good! Best Lawyer Ever

Mr. Carpenter really helped me during my time of need. He always answered all of my questions no matter how ridiculous they may have been or how busy he was. GOMAR rebuttal

After a CID investigation I was served with a GOMOR accusing me of fraud, larceny and fraternization. The accusation was that I had corrupted a lower ranking Soldier by conspiring for him to receive a higher BAH amount during deployment by using my address. The entire accusation was false. The E4... was going to rent my house from my family, signed a lease but his family never moved in. The CID investigation and ESC wanted to blame me for the E4 submitting the lease and attempting to get a higher BAH than the area where his family lived. Mr. Carpenter advised me prior to the CID interview so I knew exactly what to expect. He also drafted an extensive 7 page response to the GOMOR. His rebuttal showed 4-5 different regulations supporting that I had the authority to rent a property to the E4 if I chose to. Once the ESC received his response they rescinded the GOMOR and the case was closed. I am confident that the advisement I received prior to the CID interview coupled with Mr. Carpenter's fine knowledge of regulation and ability to articulate that understanding into responses are the reasons the case was dismissed entirely.

Army GOMOR rebuttals require a great deal of thought, research and, yes, political will power. Your case was no different, and we are gratified it was torn-up!

Do whatever it takes!

Stephen Carpenter was recommended to me by the Executive Officer of large military installation located in Washington State. When I confided that I could not afford Mr. Carpenter’s services, the Executive Officer looked me directly in the eyes and stated, “I have seen him work. Stephen assured me that he would work tirelessly to achieve the best possible result for both me and my family. Stephen and his staff never once lost sight of the fact that my family was going through all of this right alongside me. Facing courts-martial, three felony convictions, and 21-years confinement as a maximum punishment, Stephen and his team went to work. In as few as four months, Stephen orchestrated the legal processes that changed my life. I will let the results speak for themselves. Stephen convinced the prosecution to change the charges to less egregious offenses. That in turn, opened the door for Article 15 proceedings in lieu of courts-martial. Lastly and perhaps most impressively, Stephen helped secured my retirement with an honorable characterization of service. Clearly, Stephen delivered on his promise to achieve the best result. And I am confident that in doing so, he saved both my marriage and the long-term security of my family in the process. In the end, I lost one rank and was forced out of the service I love, but if you’d have asked at the beginning if I would have traded a stripe for my marriage, for my kids’ college educations, and for a future in the civilian workforce—I would not have balked. As a result of what he accomplished, the money will be quickly recouped in retirement pay. No truer words have ever been spoken, “You cannot afford not to hire him.”
