Breach of Fiduciary Duty and Professional Negligence in Legal Representation

I retained Jennifer to represent me in a divorce proceeding that subsequently evolved into a custody dispute. Throughout the course of representation, I observed a consistent lack of preparedness and organization during court appearances. On multiple occasions, I was compelled to correct factual inac...curacies in her statements, which undermined the integrity of my case. Communication from both Jennifer and her paralegal was persistently deficient. Inquiries often went unanswered for extended periods—sometimes exceeding a month—despite the time-sensitive nature of the matters at hand. This lack of responsiveness constitutes a failure to maintain adequate client communication, as required under professional conduct standards. I paid approximately $20,000 in legal fees. Despite this substantial payment, I was subjected to undue pressure regarding an outstanding balance. During a phone call, I remitted half of the remaining amount and committed to paying the balance within two months. Nevertheless, I was informed that this arrangement was unacceptable and that my representation would be terminated. This abrupt withdrawal, particularly in the midst of ongoing litigation, raises serious concerns regarding breach of fiduciary duty and failure to act in the client’s best interest. Moreover, the firm’s actions appeared to prioritize financial recovery over ethical obligations to a client facing financial hardship—specifically, the absence of child support payments for over two years. The conduct exhibited suggests a disregard for the duty of loyalty and reasonable diligence owed to clients under the applicable rules of professional responsibility. Based on this experience, I cannot recommend Jennifer or her firm, and I will not seek their services in the future.
