May 30, 2012OUTCOME: Victory: Immigration Judge terminated removal (deportation) proceedings and U.S. Citizenship & Immigration Services (USCIS) subsequently issued unconditional permanent resident card to client.
Client was given conditional (2-year) legal permanent resident status by virtue of the family-based immigration case his step-father filed for him. Although client was granted status through his step- ... father, client's mother never actually acquired permanent resident status through her husband (client's step-father), and they eventually divorced. Prior to retaining Kevin D. Slattery, P.A., client was unsuccessful in getting U.S. Citizenship & Immigration Services to remove the conditions of his permanent resident status. USCIS then placed client in removal (deportation) proceedings. For legal reasons based on the fact that client's mother never acquired permanent resident status through her husband (client's step-father), we argued to the Immigration Judge that client was improperly given conditional status initially and that, all along, he was an unconditional permanent resident.
