OUTCOME: The decision by the FAA’s Office of Dispute Resolution for Acquisition reversed the course of over a decade of anticompetitive procurement activity by the FAA.
FH+H attorneys recently won a decisive ruling in their protest of the government’s anticompetitive procurement practices. The FH+H team, led by partner Christian B. Nagel, successfully argued that the ... FAA’s award to Kevlin Corporation (“Kevlin”) as its sole provider of air traffic control radar systems’ rotary joints, violated government regulations requiring competitive procurement process. FH+H client Diamond Antenna and Microwave Corporation (“Diamond”) had previously protested a similar award to Kevlin without success, and retained FH+H to replace its previous counsel on this protest.
OUTCOME: Client's successful verification as a SDVOSB in the VetBiz VIP database.
As a recent example of its continuing commitment in assisting veteran-owned small businesses, Fluet Huber + Hoang's contracts team led by Partner Francis Q. Hoang was instrumental in advocating for and ... achieving a complete reversal of the U.S. Department of Veterans Affairs (VA) Center for Veterans Enterprise's (CVE) initial denial of a client's application for service-disabled veteran-owned small business (SDVOSB) status. For many veteran-owned small businesses, verification as a SDVOSB in the VetBiz VIP database is an essential element of its operations that opens up business opportunities that would otherwise be difficult to obtain or simply unavailable. This essential verification becomes jeopardized for many small businesses when the CVE is unable to reasonably conclude that new and existing applicants meet the express requirements for veteran-owned small businesses contained in the Code of Federal Regulations. Despite the Georgia-based small business client's receipt of an initial denial letter from the CVE as to SDVOSB status, Fluet Huber + Hoang was able to analyze the issues raised by the CVE and work with the client in providing the information and arguments necessary to overcome such issues in a Request for Reconsideration.
