Our 78-year-old client was struck in the parking lot of the Corpus Christi Wal Mart when exiting the store. Wal Mart had 18 other patrons run over in the 5 years before this accident at other Wal Mart ... stores. One of those other incidents occurred at the same store and the exact location where our client was struck 4 months prior to our incident and involved a mother and her infant. Wal Mart had at least 30 other Texas stores with stop signs at the end of each parking row, but chose not to install them at the Corpus Christi location.

She was life-flighted from the scene and raced to the hospital, where she was diagnosed with a closed head injury, fractured skull, and bleeding on the brain. Our investigation revealed the gap in the stair railing measured in excess of three times the space allowed under the building code.

He suffered 2nd and 3rd degree burns to 60% of his body and spent almost two months in the burn unit at UTMB in Galveston. The case was tried for four weeks in the 55th Judicial District of Harris County, Texas.

The gap in the stair railing measured in excess of 12", more than three times the amount allowed under the requisite building codes.
