Plaintiff's motion for summary ju ... dgment was granted and the court awarded Plaintiff $3000 for each of the 100 faxes that the defendants admittedly sent to Plaintiff over the four-year statutory period. The Telephone Consumer Protection Act (TCPA) allows for enhanced damages for willful or knowing violations. The court found the TCPA violations to have been both willful and knowing. The judgment is believed to be one of the largest individual (as opposed to class-wide) judgments in a Missouri state court for violations of the TCPA.
