Client, John Doe, was charged with attempted murder of his wife. John Doe pleaded not guilty on grounds that he was protecting his young son from being run over with a car by his wife. The incident o ... ccurred in the horse shoe shaped driveway of his home in Homewood, Illinois. According to John Doe, his wife backed into him with her car and pinned him against his car, just after John Doe was able to push their child out of danger. John Doe then testified that his wife pulled forward, but that when he saw her backup lights flash on he pulled a revolver from his pocket and attempted to shoot out the tires of his wife's car. John Doe's wife was struck in the leg with a bullet and she drove away. The jury was unable to reach a verdict and the Judge entered a finding of "Hung Jury". The State was intent on winning this case and even brought in laser technology to illustrate the trajectory of the bullet to no avail. We considered this a victory.
OUTCOME: Our client retained custody of his minor child.
