During my journey to find my forever home, I submitted an offer which was accepted on a beautiful condo. The inspection was completed and the findings were submitted. The seller agreed to make the repairs indicated in the report. A visible leak in the common hallway of the building was identified and... addressed in the inspection report, as well. However, it was determined to be the responsibility of the HOA. Unfortunately the HOA was unable to address the issue until well after my set closing date. As a result, I decided it was in my best interest to cancel the deal, as the HOA was not financially healthy and therefore, not in a position to finance said repairs without a possible special assessment. Unfortunately, I was not interested in purchasing a condo with a large leak in the hallway which shared the outer wall of the unit I planned to purchase. The seller refused to return my earnest money, stating the leak in the hallway of the building, is not inside the unit and therefore not his responsibility. Attorney Muhammad reassured me that I was legally within my rights to cancel the deal and she would make sure my earnest money was returned to me. She consistently followed up with the seller’s attorney while rarely receiving a response. The determination, passion and articulation of the law Attorney Muhammad displayed was very reassuring. Her fearless pursuit of the return of my earnest money was greatly appreciated. As a result of her hard work and diligence, it was returned to me approximately two months later.
