Costly Error

We hired Joshua Holleb on 5/6/2014 to represent our firm in a union case where my company was a defendant. We responded to the union audit with documentation to defend that the amount of their claim was not correct. We sent the critical documentation in the form of a letter on 6/9/2014 to the lawyer ...for distribution to the union and he acknowledged its receipt. Three months went by with no resolution and back and forth with both lawyers (interrogatories, discovery, disclosures, court appearances, etc.). Finally, the opposing attorney sent back another audit on 9/5/2014 with a reduction of the amount owed but it did not address the letter that I sent to my lawyer on 6/9/2014. I had to send the exact same rebuttal letter sent in June directly to the union on 9/10/2014. The union and their attorneys indicated that they never received the rebuttal in June. We then asked for a confirmation from our lawyer that he forwarded the information in an email or letter and he denied and ignored our request to date. Thereafter, we were able to come to a resolution with the union at a reduced amount down to $832.97. However, we still had to pay their auditor and attorney fees at approximately $12,000 in addition to our legal fees. We feel that a certain portion of legal fees on both sides were unnecessary and unreasonable during that three month period. We tried to negotiate with the union and my attorney with their fees with no luck. My attorney then turned around to sue our firm even though we offered them a fair settlement once we pointed out their error. Ultimately, we settled and paid our attorney $11,500 since our new attorney indicated it would be too expensive to defend a legal malpractice claim. Overall, we lost approximately $25,000 for an $833 claim. This amount would have been greatly reduced if our lawyer had not failed to follow our direct instructions and we would have had a resolution sooner.
