About me


Mr. Kipnis's practice focuses primarily on
construction law, complex commercial litigation, government and internal
investigations, and legal compliance and risk management issues in doing
business abroad.  He helps companies successfully litigate design and
construction defect claims, delay claims, disputes over insurance coverage, as
well as matters involving government contracts and procurement, international
contracting, green design and LEED issues, licensing, and other matters.  His
clients include U.S. and foreign contractors and subcontractors, architectural
and engineering firms, EPC firms, construction managers, equipment and materials
vendors, governmental organizations, owners and owners' agents, financial
institutions, as well as directors, officers, and professionals employed by
these companies.

Additionally, Mr. Kipnis helps companies conduct
internal investigations and investigations of their business partners in cases
of suspected violations of the law, as well as for due diligence and compliance
purposes.  He also helps clients design and deploy successful compliance
programs to reduce the risk of future violations.  He focuses on helping
companies manage the risk of fraud (including the False Claims Act (FCA) and
related state laws), corruption (federal and state public corruption laws, as
well as the Foreign Corrupt Practices Act (FCPA), UK Bribery Act, and the OECD
Convention), racketeering (including RICO), export controls, and other risks.
 He is well-versed in cross-border investigations, including compliance with
international data privacy laws.

Mr. Kipnis began his legal career with Stein Ray
LLP in 2005.  He is admitted to practice in Illinois, New York, and New Jersey.
 Mr. Kipnis speaks fluent Russian.

Representative Engagements

Mr. Kipnis has successfully helped, among

  • A global MEPS design firm to defend against a $25
    million design defect and delay claim regarding a state-of-the-art courthouse

  • A well-known global water and environmental
    engineering firm to defend against a $10 million design defect claim arising out
    of the design of a municipal water system

  • A top foreign-based global telecommunications EPC
    firm to conduct a series of worldwide internal investigations and to design a
    global compliance program following allegations of corruption and violations of
    the Foreign Corrupt Practices Act

  • A consortium of lenders to defend against a $600
    million lender liability lawsuit brought by the developers of a luxury hotel and
    condominium development in Chicago in one of the largest lawsuits of its kind

  • An electrical engineering firm to defend against a
    $4 million claim arising out of a fire on a municipal rail system

  • A publicly-traded owner to recover over $30 million
    from insurance companies to cover liability arising out of an advertising

  • Several of New York's most prominent architectural
    and engineering firms in connection with nearly $700 million in liability claims
    asserted by first responders at the World Trade Center site

  • A global oilfield services EPC firm develop and
    deploy an effective compliance program following allegations of corrupt payments
    to foreign officials and officials of foreign state oil companies

  • A major Chicago developer in connection with a
    series of defect claims by condominium boards totaling in excess of $40 million

  • An architectural firm to defend a $12 million claim
    for design errors in connection with an
    upscale ski resort

  • A school district to assert a $6 million claim
    against its insurance carrier to recover payment for tornado damage

  • An infrastructure and industrial EPC firm in
    connection with the owner's $12 million claim alleging design defects at a food
    processing facility.



In his free time, he enjoys reading, travel, Formula One racing,
and above all, spending time with his family. 
He and his wife have recently climbed Mount Kilimanjaro, and are
currently training to summit Aconcagua.
