Plaintiff was a customer at a bar located at 3511 N. Clark St., Chicago, on the evening of March 11, 2006. Shortly after 12:00 a.m. on March 12, he slipped and fell on the stairway to the basement alle...gedly because the stairs were covered with spilled drinks and a substance that appeared to be vomit. Plaintiff also contended the stairwell was inadequately illuminated and he could not see the substances on the steps until after he fell and was lying on the liquids. Plaintiff M-27 carpenter sustained right tibia and fibula fractures requiring open reduction internal fixation surgery with placement of a plate and ten screws ($35,138 medical bills). The incident occurred shortly after midnight following the annual Chicago downtown St. Patrick's Day Parade earlier that afternoon (March 11). Testimony showed this was one of the busiest days and nights of the year for the bar; at one point during the night there was a line outside the door, and all patrons were given plastic cups to hold drinks as opposed to glassware. The defense maintained the Plaintiff was intoxicated and was solely responsible for his own fall. Two bar managers and the police officer who responded to the scene all testified that he appeared intoxicated. However, Plaintiff presented evidence from the responding paramedic and the emergency room records which indicated he was not intoxicated; he was given morphine at the emergency room and morphine is contraindicated with alcohol intoxication. The defense denied the presence of any spillage or substance on the stairs and claimed Plaintiff was found in an area that was clean and free of hazards; the managers and the police officer all disputed there was any liquid or any other substance on the stairs. Defendant's electrician/lighting expert testified there was adequate light in the stairway where Plaintiff said he fell. The insurance company for the bar never made an offer prior to trial. The insurance company paid attorneys to appeal the verdict to the Illinois Appellate Court. Keating Law Offices not only won the verdict, but won the appeal, and obtained post-judgement interest in addition to the verdit.
