Jul 05, 2016OUTCOME: Twelfth Dist. Court of Appeals agreed with my position-consent is not requires when a parent VOLUNTARILY agrees to a no support and no contact order woth his children. Step-Father was able to asopt the children!
Step-parent adoption where consent is required UNLESS the absent parent has had no more than minimal contact or support with the minor child. Father agreed he had no contact or support with the child ... , however, he believed that consent was still required because of a court agreement he entered into divesting him of his support obligation and contained a no contact order. Father believed that this court order-ordering no contact-should result in the courts stating that consent was requires because he wasn't "allowed" contact.
