Non-English speaking Hispanic male was involved in a roll over accident in a rural county. He was taken by life flight to rural hospital where he was badly and barely treated for six hours. He was gi ... ven a RX for seven days of hydrocodone. Six days after the accident the insurance adjuster comes to his home with the driver of the car and a Spanish interpreter/minister. Client signs a release and gets a check for $1700.00. Client testified he was on his last amount of medicine and was told this money was for more medication. He cashed the check. Later it is discovered he has a broken neck and is required to have a six (6) level fusion. We filed suit and tendered the $1700.00 back to the insurance company. That check was never cashed of course. We survived the motion for summary judgment and went to mediation.
