My practice focuses on federal telecommunications matters with a particular emphasis on federal Universal Service, and domestic and international Section 214 authorizations.
I use my prior experience as an Assistant General Counsel with the Universal Service Administrative Company (USAC) to help telecommunications providers understand and comply with their FCC-mandated federal universal service reporting and contribution requirements. I also help federal universal service beneficiaries navigate the High Cost, E-Rate, and Lifeline programs. I specialize in shepherding federal universal service contributors and beneficiaries through the complex federal universal service audit process. My expertise allows me to help federal universal service contributors come into compliance with their regulatory filing requirements while minimizing potential sanctions. I have helped federal universal service contributors and beneficiaries negotiate compliance plans and settlement agreements with the DOJ, FCC, and USAC.
I help domestic and foreign telecommunications companies navigate the complex Section 214 authorization process. I regularly file applications for domestic and international transfers of control, as well as requests for Special Temporary Authority (STA). I am particularly adept at the Team Telecom review process, and have extensive experience preparing responses to Team Telecom triage questionnaires.
I have experience handling complex federal Telephone Consumer Protection Act (TCPA) regulatory compliance matters. This experience includes advising major financial institutions on TCPA compliance issues related to authentication and customer verification services, counseling an electric cooperative and its members on TCPA requirements related to informational and telemarketing calls, and regularly reviewing and providing advice regarding the applicability of the TCPA to new and emerging products and services.

"I have seen Kristin achieve incredible results for her telecommunications clients. She is able to achieve these results in part because of her past experience working for the Universal Service Administrative Company in Washington D.C. and in part because of her careful attention to detail. Having worked as an Assistant General Counsel at USAC for many years in Washington D.C., Kristin has unique insight into how the federal Universal Service Fund and beneficiary programs work and can advise her clients on what can be an overwhelming and complicated process. Kristin has helped many telecommunications providers and fund beneficiaries ensure compliance with federal telecommunications regulations and has helped clients minimize exposure for alleged noncompliance with those regulations. Kristin has a highly specialized set of experience and skills that few other attorneys possess. I wholeheartedly endorse her."
"I worked with Kristin Berkland extensively on telecommunications and regulatory matters while we were in the same Regulatory Affairs practice group at my prior firm. Kristin is not only extremely knowledgeable with respect to the telecommunications practice (including USAC and FCC matters), but she is also a problem solver and pragmatic in her approach to helping clients achieve their goals. Kristin's professionalism is second to none, and I wholeheartedly endorse her as an attorney."
