I started my professional relationship with David in approximately 1998 when my Worker's Compensation carrier would not provide me with timely payments. Within about 2 months I not only began receiving payments but received all money due as well. From there, David went on to pursue a settlement in re...lation to my full body disability. This was settled expedisioiusly as well and I received a proper settlement. David explained to me on my initial visit not only his fee schedule (which was in line with any other attorney's fees.), but the entire process as well. The stipulation of settlement included lifetime coverage for any related medical expenses to my work injury. During the years I had called him with a number of related questions which he answered almost immediatley. In 2010 the Worker's Compensation carrier decided that they were no longer going to cover rmy much neeed medication therapy. When I notified David, he picked up my case as though it was the ony case he had and reacted with immediate and appropriate action. Although we did not win the initial Administrative Hearing (this was my fault for not provideing David with all the needed information prior to the hearing), David reacted by fileing for a formal "medical coverage hearing". David informed me that our chances of winning the case were slim even though my doctor's had provided excellent letters explaining why I needed the perscribed medication. After numerous discussioins with him I asked him if it would be better to just ask for a "lifetime settlement" and close the case while still requesting lifetime medical coverage for my disability. David informed me that he would rarely if ever recommend such an action, however, in my case, it may be in my best interest as again our chances of winning the case were slim. David explained how a settlement figure is determined and we came up with an acceptable figure.David was empathetc toward the amount knowing that I expected more but we agreed to request the seettlement. The insurance carrier replied that they were willing to settle, however, at a much lower amount than we had requested. David knew that the amount was far to low and that I would never accept it, yet took the time to call me and let me know. After another round of negotiations, David called me on a Saturday. Having the carrier on another line we finally agreed on a figure that was amicable to both parties. In a matter of 20 minutes on the phone the case was settled. David then explained to me the process of how the carrier would procure a third party to work with Medicare for their approval. He explained that this could take anywhere from weeks to months, however, he wouid keep pressure on them to expidite the process. Within 2 months, I received 2 letters from David that he had sent to the carrier asking the status of the case. Following the second letter, the carrier responded that they were in the process of drafting the final stipulation for Settlement". Althuogh the case has yet to be formally settled, I have every confidence that David will continue to "push" the carrier to settle this case as expediciously as possible. I am also confident that David will keep me updated as to the staus of the settlement due to his past performance. Throughout this entire process David remained respectful, (knowing that my expectations were much different than reality), empathetic toward me knowing that I was in chronic pain, expedicious in all correspondence from requests to the court to updateing me as to where the case stood as well as answering my large amount of questions. David taught me alot and explained things to me in laymans terms. He was firm but professional with all dealings I witnessed not only in dealing with the Worker's Compensation carrier, but with the Administrative Hearing Judges as well. In closing I would say that I would highly recommend Mr. Erspamer to anyone in dealing with Worker's Compensation.
