When it becomes impossible to pay debts, bankruptcy may be a debtor's most appropriate option. If a debtor qualifies for a Chapter 7, all or most of the debtor's debts can be fully discharged, giving the debtor an immediate fresh start. In most cases, all of the debtor's assets are exempt, meaning the debtor will come out of the bankruptcy still in possession of all of their assets. If a debtor does not qualify for Chapter 7, the debtor may file for bankruptcy protection under Chapter 13.

When a person dies leaving assets subject to probate administration, it is necessary to settle their estate utilizing some form of probate proceedings, which may include: formal or informal probate, summary settlement or assignment or transfer by affidavit. In most cases, debts are paid and remaining assets distributed to the decedent's heirs or named beneficiaries. I help clients decide on the most appropriate method to administer the estate and represent them throughout the process.
