Review of William W. Wirkus We were most fortunate to have William Wirkus and his firm recomended to us as counsel when our company was unexpectedly faced with a very serious wrongful dismissal litigation, the ultimate costs of which, thanks to certain arcane aspects of the Wisconsin employment ...statutes , could have approached several hundred thousand dollars. Bill Wirkus was at great pains to listen, at considerable length, to our summary of the background of the case, the facts of the employment and subsequent dismissal of a commissioned sales agent of some six year’s standing. He ensured from the outset that he fully understood our business model, the history of the firm and particularly the nature of the relationship between the company and the employee over the employee’s six years with our company. After reviewing the considerable supporting documentation regarding the employee’s period of employment, he provided us with an assessment of our risks and potential outcomes depending on whether we wished to negotiate a settlement immediately or proceed to trial. Based on his risk summary we elected to litigate. Once the plaintiff’s complaint and our answer had been filed with the court Bill advised that we might well consider offering to mediate the matter, in as much as that would considerably speed up arriving at a resolution but also significantly reduce the costs to both parties. We agreed and the other party accepted. A date in mid-June. Bill then walked us through the mediation process, recommended how best to respond to questions of the mediator and/or the other party and how the process could be expected to unfold and to hopefully provide for agreement during the course of a day. In the event, the mediation process went very nearly exactly as he had forecast, and agreement was in fact reached. He then drafted the settlement agreement that was accepted by the other party without change. Having Bill’s experience and knowledge of the law and procedure available to us gave us the information needed to make informed decisions leading a speedy and affordable outcome. We recommend Bill and his firm most highy.
