Don’t walk, RUN, if your case is assigned to Jim

Jim Weston represented me ineffectively for a car accident in which I was an injured passenger, *and a drunk driver was at fault*. What should have been a cut-and-dry win was not, because attorneys for the drunk driver at Progressive Car Insurance were prepared to go to trial and Jim Weston was not. ...He said “ummm” no less than ten times in his opening statement (check the court transcript!), and right out of the gate I was deeply concerned at trial. My gut instincts were right. We lost!! To a drunk driver who had already tacitly admitted fault and was willing to settle out-of-Court. I ended up having to pay my medical bills OUT OF POCKET, and I had to pay for expert witness testimonies as well. I ended up going through a period of feeling suicidal over this injustice. In the days leading up to trial Jim advised me to reject a $26,000 settlement offer. I ended up “in the hole” over $10,000 in fees when everything was said and done, instead of with a 26K settlement. We live in a world where we have to depend on jurors, and Jim Weston is a fat lazy bastard and jurors also pick up on that immediately, whether fair or unfair “ummmmmm....”. I was impressed by the opposing council for Progressive Car Insurace. They said “ummmm” and were bewildered ZERO TIMES in their presentation. I feel like I took a knife to a gun fight, it was instantly obvious that Jim Weston was not in the same league as the attorneys we were up against. I had no idea of my appeal rights at the time - if I had I would have applied for ineffective council and for a retrial or to take the original settlement offer. Total bummer.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
