Jan 21, 2025OUTCOME: Jury Verdict of $2,237,500
This case involved a rear-end collision on southbound I-25 involving 3 cars. Our client was at or near a stop and was the first car hit. The defendant was 78 years old at the time of the crash. He admi ... tted to being distracted before the crash, but the defense never admitted liability. Our client was 22 years old at the time of the crash and and had worked as a self-employed barber since he was 17 years old. He was also working on a computer programming degree at Metro State University with the hopes of becoming a game developer. Before the crash he was very active, going to the gym nearly every day. Socially, he lived the pretty typical carefree life of a 22-year-old. Our client sustained neck and back injuries. He initially did chiropractic treatment. About 3 months into treatment, he obtained an MRI of his neck that showed 3 herniated discs. After that, he was referred to pain management for epidural steroid injections. He did two injections about 6 months apart. After the first injection he started physical therapy, which he found to be really beneficial. He started doing the home exercise program he learned in PT religiously and stopped going to PT sessions. He did a second injection in February of 2022, and did not return to treatment again until late 2023. He was really hoping to avoid getting additional injections, but his pain levels gradually returned to the pre-injection levels, forcing him to get additional conservative care and another round of injections. He also experienced severe driving anxiety after the crash. He underwent counseling where he learned some coping strategies, but he still has issues with driving anxiety today.
