$1,000,000 Penalty Abatement
N/AOUTCOME: Successful Abatement of a Million Dollar civil penalty.
A client was erroneously assessed a civil penalty for failure to file required information returns as required by the Affordable Care Act. The Service assessed a penalty per employee per month the clie ... nt supposedly failed to provide required adequate medical coverage. This penalty equaled more than $1,000,000 with interest. The client turned to me to help them figure out how to solve this. The client fit very neatly into the crave out in the statute for seasonal workers. When contacted by the Revenue Officer for collection of this supposedly outstanding $1,000,000 civil penalty, I explained the situation, provided the necessary documentation, and requested the civil penalty be abated (removed).
