Petitioner was being deported because of an old drug conviction under Ga 1st offender's act so it was not a conviction under Ga law. The INS still views it as a conviction. Petitioner had been told by ... her trial attorney that the 1st offender plea would keep her record clean and not cause her any problems with her immigration status. Based on this Mis-advice, the Supreme Court ruled that she should be allowed to withdraw her plea. Her case was then dismissed.
