Kevin Marciano and David Cherry settled a liquor liability case for $4.3 Million on behalf of a 46-year-old woman in DiPietro v. DiPietro and Dilworthtown Inn and Blue Pear Bistro. Plaintiff Joanne D ... iPietro was a passenger in a car driven by her husband, defendant Joel DiPietro. Mr. DiPietro had consumed numerous martinis and beer at both defendant's restaurants and bars, Dilworthtown Inn and Blue Pear Bistro. Evidence revealed that he was visibly intoxicated at both the Dilworthtown Inn and Blue Pear Bistro. After leaving the Blue Pear Bistro, he struck a tree and Mrs. DiPietro is now a quadriplegic. Mr. DiPietro’s blood alcohol was more than twice the legal limit. Mrs. DiPietro was 44 years old with two children, 13 and 4 years old. At the time of the collision, the couple had been separated. Subsequently, Mr. DiPietro was sentenced to jail for the collision and now a divorce action and custody battle is pending. Mrs. DiPietro will never be able to work again or care for herself or her children. A portion of the settlement will be given to Mothers Against Drunk Driving. Cherry Fieger & Marciano continues its plight to protect the roadways from drunk drivers.
