Client was arrested when we went to court for a misdemeanor DUI charge in Loudoun County. Client had met the alleged victim on a social media dating site. The two had gone on a date and talked through ... text messages. During the text messages, client allegedly threatened to kill the alleged victim. Commonwealth had text messages and phone records indicating the messages came from the phone that was in my client's possession. Bond denied in both General District Court and on appeal in Circuit Court.

OUTCOME: Pled no contest to Domestic A&B (M) for time served

Client and alleged victim were cohabitants living in an apartment together. Client had been drinking and got into an verbal altercation with the alleged victim when she entered his son's room. Argument ... turned physical when client grabbed victims arm. She pushed him and the two fell to the floor. While on the floor, client puts hand around her neck which cut off the airway of the victim causing her to start to see black. Scratch marks on both from scuffle. Bond granted in JDR court but decided to not post due to victim still in home, not much family around, and to use as bargaining tool.

Client was pulled over around 1 am in the morning in Loudoun County after going out to dinner with friends in which they split a bottle of wine. Had an arrangement to meet a woman at her home around 11 ... pm at night but ended up going to a bar after she cancelled. While driving home, client became physically sick to his stomach and put on flashers to pull over. Officer stopped client and said he smelled alcohol. Client had a Hall's in his mouth. Performed FST's even after telling officer he had a corn in his foot that makes it very difficult to walk or stand on one leg. Said ABC's correctly and performed finger dexterity test sufficiently. Did not blow into PBT. Got sick in patrol car and was taken to the hospital. Challenged probable cause for arrest.

Client had been at a party drinking in his girlfriend's apartment building. He was outside in the parking lot at his car with the music blaring. Cops were called and they tried to get him to turn down ... the music. He would not listen to the police so they arrested him for being drunk in public. While being arrested in the police car, client started struggling and a second officer came to the aid of the first. Client ended up kicking one officer in the head and face, trying to bite another, etc.

Client was at the mall. Went into one store and took items. Left store and went to vehicle. Was approached by loss prevention and officers at his vehicle. Searched him and his vehicle. Recovered the it ... ems and found marijuana, scales, and baggies in his vehicle. Client had 3 prior petit larceny and one possession of marijuana conviction in the Commonwealth of VA and 2 petit larceny convictions in North Carolina.

Client went to Walmart to buy a set of plates. She went back to the Walmart to buy the same designed plates but a smaller size and brought in a plate she had previously bought. Went to customer service ... to ask if they had the same plate design in a smaller size after not being able to find them. Customer service gave her a refund on her previous plates she had bought. While leaving with her plate she had previously bought, she was approached by loss prevention but stated she could not stay even though cops had been called. Two days later, she discovered the refund and went back to Walmart and repaid for the plates. She was arrested shortly after.
