When she fell, she broke her arm which required surgery and an external fi ... xator. The City would not offer her a dime so we had to try the case. It was clear from the depositions and testimony of the witnesses that this sidewalk had been a problem, and they attempted a repair instead of replacing it. The repair masked the height difference so you could not see the uneven portion which is what caused Ms. Phillips' fall.
