There are significant facts missing from Betty's review, which makes the review unreliable and inaccurate. Betty fails to mention that the father (a party to the case) was fully on board with Betty receiving all of his parenting time for grandparent visitation. Over the course of the case, the mother and father ended up talking and ultimately agreeing to signing an affidavit (through the advice of their respective attorneys) stating that they opposed an order for gp rights, which precludes gp rights in this case by statute as written. Betty's review also fails to mention that CPS was involved during the the case, which caused a significant delay because the family case was stayed until CPS finished its case. During the CPS case, Betty and her husband were not permitted contact with their granddaughter, which caused a lot of problems emotionally for Betty (understandably so). The motion for gp rights itself not only cited the relevant provisions of the gp statute, but Betty was fully advised of all of the potential risks and outcomes from the beginning. Betty undoubtedly loves her granddaugther very much and she is likely a much better provider than the child's parents; however, Betty will never accept the outcome of the case and the lawyer and court system will be blamed for it. Betty should make her complaints to the legislators in Michigan and change the law for grandparents. I wish Betty and her husband the best and hope they get to be a part of their granddaughter's life.
