Oct 07, 2014OUTCOME: Decision was Overturned and Remanded for: proper analysis of the weight given the opinion of the Treating Physician, and proper analysis of the limitations caused by claimant' Fibromyalgia.
Appeal of the Unfavorable Decision of an Administrative Law Judge in a Social Security Disability claim, stated to the United States District Court, Northern District of Ohio. Appeal claims: (I) ... The Unfavorable Decision of the Judge was contrary to the substantial evidence. This assertion was based on the Administrative Law Judge's failure to: (a) Consider the affect of a severe medical condition on her ability to work; (b) Consider the side effects of prescription medications on her ability to function; (c) Evaluate the limitations caused by Fibromyalgia as required. II. The Decision failed to give the opinion of the "treating physician" the weight required by statute. III. Social Security failed to prove that a significant number of jobs remained after her limitations were considered.
