You need to be divorced, legal separated (by judgement) or in the process of either to gain a support order.

He will probably give him an offer of pay x amount and stay out of jail. Pay nothing and go to jail.

If you have enough things that you care about to write out a will I would spring to have it done by a lawyer. Wills are not that expensive.
