Sep 12, 2012OUTCOME: My client prevailed, was awarded more personal property to offset his wife's dissipation of the business inventory, and he received an easement for the septic system that serviced his real estate but was located on the wife's real estate.
During the divorce case, the wife was allowed to run the family business. The judge decided that the husband should be awarded the business. When he re-entered the business he found that tens of thou ... sands of dollars of inventory were missing, sales had not been accounted for and sales tax was not paid. He also found that in dividing up the real estate, there was an issue as to who "owned" the septic system. I was then hired to request that the judge set aside the property division. The judge granted the motion and a second trial was held on these issues.
