Workers' Compensation Fraud

The State of Florida brought forth allegations of Workers' Compensation Fraud for a client in his mid-70's claiming that he was feigning or exaggerating his injury and unlawfully collecting compensatio ... n. The client was employed by the County and he was injured on the job. The case took over one year battling the State to prove that the client was truly injured, was not cleared to go back to work by his providing doctor and that he genuinely tried going back to work numerous times. As soon as the client was cleared to go back to work, he was fired on the spot. This made it glaringly obvious that he was being wrongfully terminated for Workers' Comp retaliation. It also later became clear that he was the victim of age discrimination. The client was facing a Third Degree Felony charge with a maximum of five years in prison. He was arrested on a warrant with a $50,000 bond. Ultimately, I was able to get the bond reduced to ROR (release on own recognizance) and we fought for the next year to prove the client's innocence. The State finally agreed to dismiss all charges against the client and his case was closed. The civil case of the client against the County came soon after.
