Another attorney prepared a defective first party special needs trust. Social Security held the trust invalid and wanted repayment of overpayments of SSI and the State tried to deny Medicaid benefits. ... We were able to "reform" the trust to its original date, which was accepted by SSA and Medicaid. No repayments of SSI were required and Medicaid benefits were not interrupted.
