OUTCOME: Successfully obtained a writ of prohibition ordering a jury trial for each client and effectively changing the future procedures of the municipal court for transfer of traffic cases to the State Court for jury trials.

On behalf of five clients, sued a municipal court judge in the Fulton County Superior Court (Civil Action 04CV94504) to obtain a writ of prohibition forbidding the city court from procedurally violat ... ing the rights of these clients to transfer of their cases to the State Court for jury trials.

OUTCOME: Successfully appealed the trial court decisions against client Peterson thereby reversing Georgia law.

This was an appeal on behalf of trial court defendant Peterson from adverse rulings in that court on competing motions for summary judgment. Through its decision, the Georgia Court of Appeals reversed ... Georgia law (239 Ga. App. 838, 521 S.E.2d 648). This was the first reported case in the U.S. under the newly-revised Uniform Commercial Code which codified the rule that an authorized representative is not personally liable when he or she signs a negotiable instrument on behalf of the represented entity, even if the instrument does not indicate on its face that it is being signed in a representative capacity (O.C.G.A. § 11-3-402(c)).
