Truck Crash
Aug 24, 2018OUTCOME: $5,000,000 policy limit settlement
On February 8, 2016, our client was driving her Toyota Prius to a dentist appointment when a roadside service truck crashed into her car as the truck attempted to make a left hand turn in front of her. ... A brain injury left our client with no memory of the crash. The only sworn testimony from the truck driver was that she turned left on a green left turn arrow. In addition to her traumatic brain injury, our client suffered numerous left sided crush injuries to her upper and lower body. Her treating physician’s also believed that our client suffered a traumatic aggravation of a pre-existing spinal condition. As a result of her injuries, our client underwent seven surgeries, hundreds of therapy sessions, and has lived with daily pain and discomfort. Our client lived independently before this crash, but has unfortunately not been able to return home due to her substantial medical and caretaking needs. After a thorough investigation and deposition testimony, we learned that the roadside service company did not require the inexperienced teenage truck driver to provide a motor vehicle record, undergo a physical examination, perform a written driver safety test, or perform a road test medical prior to hiring her to drive the truck she was driving at the time of this crash. The case settled for the truck company's entire $5,000,000 policy after the depositions of the truck company's experts -- just days before trial.
