Domestic Violence Charge Dismissed

OUTCOME: Case Dismissed

Client was charged with domestic violence, in Fairborn Municipal Court, after getting into a physical confrontation with his live-in girlfriend that sent her to the hospital with a facial injury. The f ... irst challenge was getting the client out of jail after the initial arrest. Ohio courts prefer to keep domestic violence defendants in custody until the case is resolved, however, Denslow was able to secure the client’s release at the first hearing, approximately twenty-four hours after the arrest. Denslow subsequently investigated the case and found a number of witnesses that could testify that the “victim” was actually the aggressor and making the case one of self-defense. As a result Denslow set the case for trial knowing it would be an easy acquittal for the client. Eventually, the prosecutor agreed and dismissed the case entirely. Client walks away with nothing on his record.

OUTCOME: Client was extremely thankful for attorney's hard work and dedication

Client was facing a laundry list of felony charges in Montgomery County Common Pleas Court, including multiple counts of aggravated murder, aggravated robbery, aggravated burglary and weapons charges. ... Denslow litigated the case for approximately one full year before the case eventually went to a two-week jury trial in February 2014. The government’s case was largely based upon circumstantial evidence including mobile phone tracking technology. After two weeks of testimony, hundreds of exhibits and approximately fifty witnesses, the hard-fought case went to the jury for a decision. Unfortunately, Denslow’s client was found guilty and given an extremely lengthy prison sentence. While you can’t win every case, the client was extremely appreciative of Jeremiah’s hard work and dedication. This case is currently under appeal in Ohio’s Second District Court of Appeals.

Client had accepted payment on a window installment job, however, due to financia ... l constraints, was unable to complete it. After months of trying to make good on his promise to complete the work, the Warren County Prosecutor’s Office eventually indicted our client on felony theft charges. After approximately nine months on the case and trial being reset numerous times, Denslow was able to work the case down to a misdemeanor with no jail time.

Montgomery County pre-indictment case in which our juvenile client was charged with Gross Sexual Imposition, a felony of the third degree. Client was represented by Jeremiah Denslow. If adjudicated del ... inquent based upon a GSI charge, he would have faced the possibility of going to youth prison (DYS/Department of Youth Services) for six months up until his 21st birthday. Not only were the police involved in the investigation, but Montgomery County Children Services investigated the family as well. After speaking with representatives from the police, prosecutor’s office, and children services, the police/prosecutor agreed to drop all charges against the juvenile. In addition, after getting the child enrolled in counseling, Children Services closed their investigation as well.

The prosecutor eventually agreed to reduce the charge to a reckless operation, fourth degree misdemeanor. The OVI charge and Leaving the Scene charge were both dismissed. We were further able to procure a great disposition--no jail time, no probation and no three-day program. Just a small fine and court costs.

The case was delayed for almost ... a full year and eventually, the police agreed not to go forward on the felony charge, just one misdemeanor charge of drug abuse instruments. Despite a lengthy record, we were then able to convince the judge not to give our client any jail time or probation. Just a fine and court costs.

Municipal Court case in which client was charged with OVI, a first degree misdemeanor and Failure to Control her car and causing an accident. In addition,client was charged with drug possession, all re ... sulting from the same incident. Client was represented by Jeremiah Denslow. If convicted, she faced possible penalties of six months in jail, $1225 in fines and a three and a half-year license suspension After a night of drinking and smoking marihuana, client made the bad decision of attempting to drive home. While at a stop light, she fell asleep and rolled into the car ahead of her. She remained asleep until the individual in the car pulled her out of the vehicle and called the police. The police promptly arrested her for OVI after she failed the standard field sobriety testing. She again fell asleep in the back of the police cruiser. After reviewing the police report, the prosecutor refused to reduce the case and insisted our client plead guilty to the OVI and the drugs found in her purse. We then filed a motion to suppress to challenge the State’s evidence, and on the day of the hearing, the prosecutor finally agreed to dismiss the drug charges and reduce the OVI to a non-moving violation, Physical Control. No jail time.

Client was charged with OVI, a first degree misdemeanor. Client was represented by Jeremiah Denslow and faced possible penalties of six months in jail, $1075 in fines and a three-year license suspensio ... n. The prosecutor was initially reluctant to reduce the charge because our client previously had an OVI charge within the prior 12 months. After challenging the State’s evidence at a motion to suppress hearing, we were able to demonstrate some significant problems with the State’s case. Our client did relatively well on the field sobriety testing, was respectful of the police officers and there were mistakes made by the police when administering the testing. While the court overruled our motion to suppress, the prosecutor recognized the weaknesses and gave us the reduced charge for which we were looking. OVI was dismissed and client pled to a non-moving violation, Physical Control. No jail time, no probation, no three-day program. Just a small fine and court costs.
