Domestic Violence Charge Dismissed

Client was charged with domestic violence, in Fairborn Municipal Court, after getting into a physical confrontation with his live-in girlfriend that sent her to the hospital with a facial injury. The f ... irst challenge was getting the client out of jail after the initial arrest. Ohio courts prefer to keep domestic violence defendants in custody until the case is resolved, however, Denslow was able to secure the client’s release at the first hearing, approximately twenty-four hours after the arrest. Denslow subsequently investigated the case and found a number of witnesses that could testify that the “victim” was actually the aggressor and making the case one of self-defense. As a result Denslow set the case for trial knowing it would be an easy acquittal for the client. Eventually, the prosecutor agreed and dismissed the case entirely. Client walks away with nothing on his record.
