OUTCOME: The Court of Appeals overturned the trial court, stating the the terms of the Will were unambiguous and the anti-lapse statues were inapplicable. The Kentucky Supreme Court denied review.

Decedent's heirs at law challenged interpretation of Decedent's Will, claiming a share of the estate via the anti-lapse statutes. The trial court ruled that the Will was ambiguous and the heirs were e ... ntitled to their share. We appealed on behalf of the Executrices of the estate.

OUTCOME: The Court of Appeals reversed the trial court stating that Defendants were not entitled to a full setoff for the amounts paid by the settling tortfeasors.

In a multiple defendant property damage case, two defendants settled prior to trial. The trial court entered an Opinion and Order awarding Plaintiff damages. However, the trial court offset the dama ... ges awarded at trial by the entire amount paid by the settling tortfeasors. Plaintiff argued that the setoff should be by percentage of fault, not total amount paid. Plaintiff appealed.
