OUTCOME: Appellate Court reversed the trial court's ruling and remanded

Represented tenant on appeal. Tenant brought a premises liability action for negligence against landlord, alleging landlord failed to maintain apartment premises in reasonably safe condition based on k ... nowledge of potentially vicious dog owned by a different tenant in the building. The Superior Court, Judicial District of New Britain, Swienton, J., granted landlord's motion for summary judgment. Tenant appealed.

OUTCOME: The Supreme Court reversed the trial court's ruling and held that held that businesses operated out of owner's building qualified as “professional offices” within meaning of easement agreement.

Commercial property owner brought action against owners of neighboring building, claiming a right of access to driveway separating the buildings, located on the defendants' property, which provided acc ... ess to a parking area behind both buildings. Defendants filed counterclaim for trespass and nuisance. The Superior Court, Judicial District of Middlesex, entered judgment for defendants on plaintiff's easement claim, and entered judgment for plaintiff on counterclaims. The Appellate Court affirmed. Plaintiff's petition for certification to appeal was granted and the Supreme Court reversed the trial court's ruling.
