OUTCOME: Father Granted Primary Custody
December of 2012, my client found and retained me. He explained that the litigation had been pending since the beginning of summer that same year. The parties have a 5 year old son and the wife unila ... terally decided to take move with the child to a different county over 50 miles away. When he came to me, he was scheduled for a final hearing less than 2 weeks later. A continuance was simply not possible. I met with him and prepared for trial. After a trial that lasted approximately 4 hours, the Judge awarded primary custody to my client. The determining factors had nothing to do with the fact that the wife had committed adultery with multiple individuals. If she had not taken the child, the child would have gone to school in a school ranked 8 in the state. Instead, she enrolled him in a school that was ranked nearly 300 in the state. She also had no apparent interest in the child’s nutrition. The Court ruled that during the academic school year, the child will primarily reside with the father and during the summer months, the child will primarily reside with the mother. The mother was ordered to pay child support for the entire year. My client is very pleased and the child has been placed where he belongs.
OUTCOME: Judge rejected the GAL recommendation
Forsyth County. Guardian recommended against my client in a modification action of 5 children. 2 day trial.
OUTCOME: Through a heated mediation, my client settled for his entire 401(k), primary custody of the children and him having visitation "as agreed upon by the parties".
This involved a 7 year marriage, three children. The Husband was extremely emotionally and physcially abusive towards his wife and the eldest child. I represented the wife, a stay at home mom. The H ... usband was a executive in a major corporation and earned well over six figures each year. He held all the assets, which including a 401(k) worth approximately 100 thousand dollars. There was a marital residence, but it had a negative equity and a lot of bad memories. My client did not want it.
