The issue in the case was whether it was in the best interests of the child to relocate from New Mexico to Utah. The child resided with the Father since birth. He has relocated several times due to his ... service in the military. His reason to move to Utah was based on a job offer. The mother lives in New York or Florida. She opposed the move because she wanted custody. I represetenb the Father.

OUTCOME: The judgment of the trial court was confirmed and the appeal dismissed. The Connecticut Appellate Court denied the subsequent petition to appeal. The defendant remains incarcerated as a result of these convictions.

I began this case in my 3rd-year in law school as part of the Prosecution Appellate Clinic under the supervision of Professor Harry Weller of the Connecticut State's Attorneys Office. I wrote the brief ... and argued the case before the Connecticut Appellate Court as a legal intern. I represented the state. The defendant appealled from a judgment of conviction, rendered after a jury trial, of three counts of sexual assault in the first degree, three counts of sexual assault in the second degree, two counts of sexual assault in the fourth degree, and seven counts of risk of injury to a child. On appeal, the defendant claimed that the court improperly (1) denied his posttrial motion for a judgment of acquittal and (2) admitted constancy of accusation testimony.
