Theresa has experience representing commercial developers, contractors, construction managers, subcontractors, private owners, public entities, design-builders, design professionals, insurance companies, sureties and material suppliers. Theresa also has experience working on claims relating to malpractice and negligence of licensed professionals, including architects, engineers and doctors.
Theresa advises clients in matters ranging from pre-litigation strategy to the decision of when to try cases, and how. Theresa also represents clients in civil litigation matters, including bench and jury trials, and continued litigation on appeal.
Mediation, arbitration and other alternative dispute resolution (“ADR”) methods can be helpful to neutralize emotions and resolve disputes in a cost-effective manner. However, ADR is not the right solution for every dispute. Theresa often helps her clients during project planning and contract drafting stage to determine what method of ADR, if any, seems best-suited for the project. If, however, a dispute arises, Theresa can also serve as an ADR advocate or neutral.
Theresa has experience drafting custom design and construction contracts on a project-specific basis. Theresa has also modified and negotiated many contracts based on industry “standard form documents” — including those published by include those published by the American Institute of Architects (AIA), the Engineers Joint Contracts Committee (EJCDC), the Design-Build Institute of America (DBIA), and ConsensusDOCS.
Theresa represents clients in actions pending in Indiana state trial courts and federal district courts. Theresa also represents clients in appellate litigation pending before the Indiana Court of Appeals, the Indiana Supreme Court and the Seventh Circuit.
Theresa experience includes providing insurance defense and coverage dispute services as well as purported breaches of insurer duties and insurance contract interpretation. For insurance industry clients, Theresa is available to provide assistance to primary and excess insurance carriers in determining the extent of coverage described by an insurance policy and, if necessary, represent them in court actions seeking to declare who is covered under a policy and the extent of the policy’s coverage.
Theresa has experience handling a diverse range of matters in state and federal appellate courts, with extensive experience on judicial review of matters involving decisions by an administrative law judge. Theresa is available to defend judgments obtained on behalf of her clients and to seek review of judgments which may be adverse to her clients. Theresa can also handle appeals and applications for review for clients who were represented by other counsel at the trial court level.

Just reached out about a situation we are in; she gave a free consultation. Don't know that we will end up needing her services, however she gave us some great advice about how to proceed, and we would use her if we needed it.
