My clients (plaintiffs) sued defendants for an eviction. Both parties were represented by attorneys. The defendant tried to claim a breach of the warranty of habitability as well as a provision in th ... e lease that stated the defendants needed 2 months notice before an eviction. I was able to defeat Defendants warranty of habitability claims by pointing to case law that required defendants to point to specific housing code violations when claiming a breach of the warranty of habitability. I was also able to defeat their breach of contract claim in the lease provision stating that 2 months notice was required before an eviction when judge accepted text messages asking tenant pay his rent or leave as notice.
